Welcome

Robyn Thomas, Executive Director

The Law Center to Prevent Gun Violence has advocated for lifesaving gun policy for the past 23 years, and never has our work been more challenging or more necessary than right now. The 2016 election generated new obstacles, with the gun lobby spending $50 million to support the president and other candidates committed to dismantling gun safety laws. But our experienced, committed team of experts is at the ready, fighting each day to defend the smart gun laws that we know save lives from the gun lobby’s deadly, profit-driven agenda.

This year, our efforts to check the gun lobby’s outsized influence were amplified by a new, exciting venture with our partners at Americans for Responsible Solutions, led by former Congresswoman Gabrielle Giffords and her husband, former NASA astronaut and Navy combat veteran Captain Mark Kelly. Together, we’re forming a new force for gun safety legislation, education, research, and advocacy that stretches from coast to coast, and we couldn’t be more thrilled to be standing united in the fight against gun violence.

There’s never been a more important time to harness our energy and pass commonsense gun safety legislation. This summer, the nation mourned the deadliest mass shooting in modern American history—an act of hate that left 49 dead and 58 wounded at the Pulse nightclub in Orlando, Florida. In the wake of this unspeakable tragedy, our legal experts provided unparalleled expertise to lawmakers across the country seeking to prevent future shootings. In these dark moments, our informed perspective and advocacy for commonsense solutions serves as a sensible, data-driven foil to the corporate gun lobby’s misinformation and fear-mongering. We are so proud to be doing our part to address this public health crisis, which claims more than 90 American lives every day.

Over the years, our unique expertise has put us at the forefront of the fight for gun safety. Legislators, activists, journalists, and academics trust and rely on us as a source for information about gun laws in the United States and the proven solutions that will help shore up public safety in our communities. But we know none of this lifesaving work would be possible without the unwavering support of the donors, members, partners, and friends who empower the Law Center to continue our work as a national leader in the fight for smart gun laws. We couldn’t be more grateful, and we are thrilled to to acknowledge their invaluable support here, in our 2016 Annual Report.

Our experts stand at the ready at this critical moment in the fight to save lives.

2016 Highlights

Gaining Ground, State by State

As the foremost experts on gun policy in the United States, the Law Center is leading the charge for smart gun laws, approaching the problem through three distinct areas: legislation, litigation, and education.

While federal inaction has led to very little progress for gun safety on the national level, state activity has been remarkable, with 160 new smart gun laws passed in 42 states and Washington DC since the 2012 shooting at Sandy Hook Elementary. This year along, our attorneys tracked 1,472 state gun bills as they were introduced in statehouses across the country. Smart gun laws enjoy broad public support, and in fact, over 90% of Americans want their lawmakers to pass commonsense legislation like universal background checks.

The Law Center is also fighting the gun lobby in the courts. For years we’ve helped defend smart gun laws against frivolous, gun lobby–backed lawsuits, filing amicus briefs and leveraging the support of our pro bono law firm partners. And there’s been remarkable success—since the landmark Heller decision in 2008, 94% of Second Amendment challenges have been defeated, and the Supreme Court continues to decline to hear new gun rights cases each year. The extraordinary success of the gun violence prevention movement in this area supports the conclusion that gun safety laws are not at odds with the Second Amendment. In an exciting new venture, we’re adding affirmative litigation to our efforts, proactively challenging the gun industry when they put profits ahead of people.

Our legal experts have an unrivaled understanding of how smart gun laws can save lives and improve public safety. Much of our work involves educating as many lawmakers, community activists, and members of the public as possible on the concrete, proven solutions to this uniquely American epidemic. Through events, media relations, our comprehensive website, and our powerful library of publications and policy guides, we help people understand that solutions exist and are in reach.

We’re proud to have met so many powerful milestones in 2016, and we look forward to all we can achieve in the year to come.

Legislation

Last year the Law Center joined forces with Lt. Governor Gavin Newsom to draft and advocate for the “Safety for All” ballot initiative in California, also known as Proposition 63. Thanks to our combined efforts, Californians voted to pass a package of commonsense gun reforms that further strengthen our home state’s gun laws. Prop 63 prohibits possession of large capacity ammunition magazines, requires background checks for ammunition sales, provides a relinquishment process for those convicted of serious and violent crimes, requires reporting of lost and stolen guns, and mandates that records be shared with the FBI for background checks. The initiative passed with an overwhelming 63% of the vote.

This year, Washington State voters approved an Extreme Risk Protective Order ballot measure. This new law, which used the Law Center’s GVRO model law as a guide, is a lifesaving tool that empowers families and law enforcement to petition a court to temporarily disarm people who pose a demonstrated risk to themselves or others. A third ballot initiative passed in Nevada, requiring universal background checks.

Additionally, six states enacted laws to keep guns out of the hands of domestic abusers and three states improved laws that keep the dangerously mentally ill from accessing firearms. Delaware closed a gap in the federal background check law, extending the maximum background check processing time from 3 to 25 days to allow for in-depth investigations.

Interested in learning more about all the gun laws enacted in 2016? Check out our Gun Law Trendwatch, our roundup and analysis of the latest news in gun legislation.

Litigation

One of the ways the Law Center takes action against the epidemic of gun violence in the United States is to stand up to the gun lobby’s frivolous lawsuits by defending lifesaving smart gun laws that have already been enacted. We achieve victories in this area at a remarkable rate, proving time and again that the Second Amendment is not a barrier to smart gun laws. Our attorneys’ research, coupled with our pro bono network, enables local leaders to legislate for public safety and stand up to the gun lobby’s fallacious lawsuits that inevitably follow.

Despite every effort from the gun lobby to prove otherwise, we continue to prove that smart gun laws are constitutional. In fact, 94% of Second Amendment challenges have been defeated since the landmark 2008 ruling in Heller v. District of Columbia. In 2016, we filed six amicus briefs in critical Second Amendment cases and assisted numerous city and state’s attorneys facing challenges to gun laws that enjoy broad public support and save lives.

One of our most critical victories in 2016 was in the case Peruta v. San Diego, in which the Ninth Circuit Court of Appeals found that California’s regulations on who can carry a concealed weapon in public are constitutional. The Law Center has been deeply involved with the case from the very start, filing several amicus briefs throughout the litigation process.

We also launched a new impact litigation project, the Firearms Accountability Counsel Taskforce, or FACT. The new taskforce, which consists of top law firms and leaders from the gun violence prevention movement, will be devoted to pursuing legal strategies to address America’s dire gun violence crisis and hold the gun industry responsible for unfair business practices that endanger public safety.

Education

Our staff of attorneys have a deep and unrivaled understanding of every aspect of gun violence prevention, from the laws that legislators can and should enact, to the community-based solutions reducing violence in our streets. It is our mission to share that knowledge with as many leaders, activists, and citizens as possible. Our publications, educational events, and relationships with lawmakers, advocates, the media, and civic leaders help spread accurate, data-driven information about the American gun violence epidemic and solutions to this public health crisis.

In 2016, we hosted our annual Second Amendment conference in Washington DC, with more than 40 litigators, advocates, and public health experts from around the nation in attendance. Participants discussed critical, timely topics in Second Amendment jurisprudence, current research being done to reduce gun violence in the United States, and updates from political and public safety experts on different types of legislation.

We also continued to publish State Gun Law Trendwatch, a biweekly analysis and roundup of the latest news in state firearm legislation, which we distribute to our partners in the movement, the media, and the public as a way to keep everyone apprised of the action in statehouses across the country.

We also released another installment of the annual Gun Law State Scorecard. Each year, we grade the states based on how strong their gun laws are. In 2016, 27 states received an F on the Scorecard, and our analysis showed that Mississippi had the weakest gun laws in the nation. California continues to lead the way when it comes to enacting groundbreaking solutions to the gun violence crisis, followed by Connecticut and New Jersey. Our research continues to reveal a strong correlation between the strength of a state’s gun laws and its gun death rate.

Gun violence was a critical election issue, with voters passing gun safety ballot initiatives in three states.

23rd Anniversary Dinner

Reflecting on Our Past to Build a Safer Future

23rd Anniversary Dinner

Each summer, the Law Center’s community of supporters and friends gathers to recognize the anniversary of our organization’s founding in 1993, following the assault weapon massacre at the San Francisco law firm Pettit & Martin. The Anniversary Dinner honors the eight killed and six wounded in that unspeakable tragedy, as well as the 117,000 individuals who become victims of gun violence each year in the United States. We also celebrate our achievements, as an organization and a movement, and present awards to the people and organizations making a profound impact in this critical space.

In 2016, we celebrated our 23rd Anniversary Dinner at the Westin St. Francis in San Francisco, with more than 450 supporters in attendance. We honored DeVone Boggan with our Distinguished Service Award for his work leading the Office of Neighborhood Safety in Richmond, CA, and for founding Advance Peace, a community-driven program to reduce urban gun violence. California Lt. Governor Gavin Newsom received our Courageous Leadership Award for his work advocating for the passage of the groundbreaking gun safety ballot initiative Proposition 63.

We also recognized Keker & Van Nest LLP with the Richard W. Odgers Pro Bono Partner Award for their work defending the city of Pleasant Hill after the gun lobby filed costly lawsuits to challenge a package of smart gun laws the city passed to keep their community safe. Keker also partnered with the Law Center to prepare a highly influential amicus brief in litigation involving Florida’s onerous preemption law, which bars municipal governments from legislating for local public safety.

The generosity of our guests, who displayed their commitment to the Law Center’s work and to this essential movement to save lives, is truly inspiring. To those individuals and organizations who donate to the Anniversary Dinner year after year, and to the sponsors who joined us for the first time in 2016, we extend our deepest gratitude.

Foundation Support

Fueling the Fight by Underwriting Innovation

Over half the Law Center’s budget in 2016 came from grants supplied by charitable foundation. We extend a heartfelt thank you to the longtime funders whose generous grants have helped the Law Center flourish over the last 23 years and to the many new foundations supplying our organization and our movement with the resources and momentum necessary to save lives from gun violence.

Standing up for smart gun laws

Thanks to the dedication and generosity of our members, the Law Center has made remarkable strides in 2016. We are so grateful for our many supporters, whose gifts enable us to craft model laws, analyze legislation, and bring the fight to the gun lobby in the courts. By volunteering, calling their legislators, or spreading our message through social media, our members are helping create the culture change we need to end gun violence in America.

The number of people supporting the Law Center this year grew dramatically, allowing us to expand our reach, launch new programming, and grow our dedicated staff. We are deeply thankful to all those who enabled our mission and our work in 2016.
